General terms and conditions of the SVEČA d.o.o. online store are compiled in accordance with the Consumer Protection Act (ZVPot-UPB1). The online store SVEČA d.o.o. is an online store operated by SVEČA d.o.o. (hereinafter referred to as the company).

 

PRODUCT PRICES

You can order on the Sveča d.o.o.’s online store in the Slovenian language via the Internet 24 hours a day and 7 days a week. You can select and order products that are available in the product list. All products listed on these pages are available as long as the stocks last. All prices are in euros and include value added tax.

All articles, shopping guides as well as pictures and product descriptions are the property of their respective authors and may not be reproduced without permission.

The company will save the text of the contract and it will be accessible to the consumer.

Information on the company’s complaint procedure

In the company Sveča d.o.o. we strive for customer satisfaction and continuous improvement of the online store business. We comply with consumer protection laws and our vision is to become a friendly online shop. But because mistakes do happen, it can occur that our performance is different from your expectations. If you would like to file a complaint about our business, you can do so in several ways. We really do not want disputes, that is why we try our best to resolve them out of court and amicably.

You can submit a complaint in writing, to the company’s headquarters (Sveča d.o.o. Pobrežje 6a, 2284 Videm pri Ptuju), or via e-mail:. We will respond to your complaints as soon as possible (no later than 30 days after receipt). For all explanations regarding the appeal procedure, you can contact us at 00 386 2 764 05 11. All unresolved disputes are subject to the jurisdiction of the district court.

Out-of-court settlement of consumer disputes

In accordance with point 7.12. of the General conditions of use of electronic communication services of the company Sveča d.o.o., Sveča d.o.o. does not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes, which could be initiated by a private user in accordance with the Out-of-Court Settlement of Consumer Disputes Act.

Sveča d.o.o. as an online sales provider, publishes an electronic link of the online consumer dispute resolution (SRPS) platform on its website. The platform is available online at http://ec.europa.eu/odr

The regulation is derived from the Out-of-Court Settlement of Consumer Disputes Act and Regulation (EU) no. 524/2013 of the European Parliament and of the Council of the online settlement of consumer disputes.

Familiarization with the company’s responsibility for real product defects

Real product defects

The consumer can claim defects in the purchased goods from the warranty or from the real product defect, as provided by the Consumer Protection Act – ZVPOt. He can make a claim for a product defect for any purchased product that has a warranty or no warranty. Thus, due to a defect in a product for which a guarantee has been given, the consumer can exercise the rights arising from the product defect. The same can be decided when he does not want to claim a guarantee for the product for which a guarantee has been granted. Due to a product defect, the consumer can complain about the defect to the seller within 2 months from the discovery of the material defect, or within 2 years after the goods were taken over by the purchaser. When exercising the rights under this title, the consumer must describe the defect in detail in the defect notice to the seller and allow the seller to inspect the product. If the defect is not disputed, the seller must respond to the consumer’s claim as soon as possible, but no later than within 8 days. However, if there is a dispute about the defect, the seller must give the consumer a written answer within 8 days. The consumer can choose between: rectification of the defect, refund of the amount paid in proportion to the defect, replacement of the goods or refund of the amount paid.

The defect is real:

if the product does not have the properties required for its normal use or for marketing;

if the product does not have the properties which are necessary and known or must be known to the seller, for which particular use the buyer is buying it;

if the the product does not have the properties that are explicitly or implicitly agreed on or mandatory;

if the seller has delivered a product that does not match the pattern or model, unless the pattern or model was shown for notification only.

The suitability of goods for the intended use is assessed in relation to common goods of the same type and taking into account any information provided by the seller or manufacturer on the condition and characteristics of the goods, in particular through advertising, product presentation or information on the goods themselves.
